Pursuant to Section 8(1) of Act No. 348/2005 Coll., on radio and television fees and on amendment to certain laws, as amended (hereinafter the “Radio and Television Fees Act”), Czech Television administers the register of TV licence fee payers and, pursuant to Section 8(8) of the Radio and Television Fees Act, of persons who are obliged to pay the TV licence fee but are not registered to do so (unregistered payers).
The personal data were obtained by Czech Television directly from the data subject in the case of registered TV licence fee payers or from relevant electricity suppliers with whom unregistered payers have an electricity supply contract or, from the basic population register for the purposes of enforcing outstanding TV licence fees and any penalties charged. Under the Act on Radio and Television Fees, Czech Television is also authorized to exchange data from the registry of payers with Czech Radio for the purpose of identifying or verifying payers. In accordance with Act No. 111/2009 Coll., on Basic Registers, as amended, and based on the registration performed by the Ministry of the Interior, Czech Television also utilizes personal data from the Basic Register of Inhabitants for the purposes of maintaining records under the Act on Radio and Television Fees and for the recovery of outstanding television fees and surcharges.
Czech Television processes personal data including the first and last name, place of residence, date of birth, data box identifier and address of the electricity supply point in accordance with Article 6 (1)(c) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the General Data Protection Regulation, hereinafter the “GDPR”), and in accordance with the Personal Data Processing Policy only for the period necessary for the performance of the legal obligation, namely keeping records of TV licence fee payers. Czech Television processes personal data in accordance with Art. 6 (1)(c) of the GDPR in order to comply with a legal obligation stipulated by the Radio and Television Fees Act. In view of personal data processing on the grounds of compliance with a legal obligation, the consent of the data subjects to the processing is not required.
Other personal data provided (e.g. email address or contact address) and the variable symbol under which the data subject is listed in the TV licence fee registry are processed for the purposes of for administration and recovery of television fees. This processing is based on Point (e) of Article 6(1) of the GDPR, as it is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller. This data allows Czech Television to communicate with the payer more efficiently and economically and ensures more accurate identification. If you have previously granted us consent to processing of other “optional” personal data for the purposes of accessing the online application or providing related optional services (p-Info), the settings or the manner of processing of your data remain unchanged. Pursuant to Article 21 of the GDPR, you have the right to object, on grounds relating to your particular situation, to the processing of optional personal data or other personal data if such processing is based on the performance of a task in the public interest or the exercise of official authority. If you object to the processing of your email address and your objection is sustained, subsequent written communication with Czech Television will only be possible via data boxes or postal services.
Czech Television also processes personal data provided by data subjects in connection with the registration and payment of the television fee pursuant to Point (c) of Article 6(1) of the GDPR, for the fulfillment of legal obligations set forth in Act No. 499/2004 Coll., on Archiving and Records Management and on amendments to certain acts, Act No. 563/1991 Coll., on Accounting, and Act No. 370/2017 Coll., on Payment System. Personal data of unregistered payers are processed for the fulfillment of legal obligations set forth in Act No. 499/2004 Coll., on Archiving and Records Management and on amendments to certain acts.
The email address provided by the payer during registration via the TV license fee website is processed by Czech Television for the purposes of creating and maintaining a user account and for the provision of the "Payer Account" service (e.g., p-Info services). Without providing an email address, it is not possible to create a user account on the website or to use the "Payer Account" service. Processing your email address is necessary to fulfill the terms of the 'Payer Account' service agreement, entered into upon account registration. This processing is carried out in accordance with Point (b) of Article 6(1) of the GDPR.
When paying by credit or debit card, personal and payment data, including sensitive payment data, are entered directly with the payment solution provider or the bank. The protection of this data is implemented in accordance with Act No. 21/1992 Coll., on Banks, as amended, and Act No. 370/2017 Coll., on Payment System, as amended. Czech Television does not possess, nor does it have access to, any sensitive payment data provided by data subjects during card payments under the aforementioned acts, particularly credit card details and other sensitive information. If a payer opts for recurring card payments to pay the television fee, Czech Television processes the card expiration date and payment token information for the purpose of executing these recurring payments, pursuant to Point (b) of Article 6(1) of the GDPR. This data is provided to Czech Television by the payment gateway provider. Payers may change their chosen payment method at any time within their Payer Account.
The payer`s email address, provided by the payer to the payment solution provider for the purpose of payment verification, may only be processed for communication with the payer regarding the payment of the television fee. The payer's personal data may also be transferred to the technical solution provider for the administration of television fees for processing purposes.
Under the conditions set forth in the GDPR, the data subject has, among others, the following rights:
to obtain confirmation from Czech Television, pursuant to Article 15 of the GDPR, as to whether or not their personal data are being processed;
to request information from Czech Television regarding the processing of personal data, in particular regarding who has access to the data, under what conditions, and how the personal data are secured against misuse;
to request access to personal data and to have them updated or rectified pursuant to Article 16 of the GDPR;
to request restriction of processing pursuant to Article 18 of the GDPR, if the personal data are inaccurate, the processing is unlawful, the controller no longer needs the personal data, or the data subject has objected to the processing pursuant to Article 21(1) of the GDPR;
to request the erasure of personal data pursuant to Article 17 of the GDPR, provided the conditions of Article 17 are met. In accordance with Article 17(3) of the GDPR, the right to erasure does not apply during the period of fulfillment of a legal obligation set forth by the Act on Radio and Television Fees;
to object to the processing of personal data pursuant to Article 21 of the GDPR, if the processing is based on the performance of a task in the public interest, the exercise of official authority, or the legitimate interests of the controller or a third party;
to request the portability of automatically processed personal data pursuant to Article 20 of the GDPR, if the processing is based on the data subject's consent or the performance of a contract;
to contact Czech Television at any time in case of any doubts regarding the compliance with obligations related to the processing of personal data;
to lodge a complaint with the Office for Personal Data Protection (Úřad pro ochranu osobních údajů), located at Pplk. Sochora 727/27, 170 00 Praha 7, Czech Republic.
Czech Television processes personal data for the period necessary for the fulfilment of the purpose of processing.
Personal data will be processed for a period for which the data subject is a payer of the TV licence fee. If the data subject ceases to be a payer of the TV licence fee, Czech Television will process the data subject’s personal data for a period of 10 years from the date on which the data subject ceases to be a TV licence fee payer.
If a natural person is an electricity consumer connected to the distribution system and if the duties following from Section 3(4) of the Radio and Television Fees Act apply to such a person, but this person is not a TV licence fee payer, Czech Television shall have a legitimate interest in the processing of personal data for a period of at least 5 years from the date of receiving such person’s declaration affirming they are not a payer.
Personal data of members of bodies of legal persons who are payers of the TV licence fee are processed for the same period of time.
